New Delhi, 01 August (HS). The Supreme Court has issued a notice to the Delhi Police while hearing the bail plea of Bibhav Kumar, arrested in the assault case on MP Swati Maliwal. The bench headed by Justice Suryakant ordered the next hearing of the case on 7 August.
During the hearing, the court expressed its displeasure over Bibhav's attitude and said that Bibhav was not ashamed of raising his hand on the young woman? We are shocked by this incident. The question is not of a small or big injury. Is the Chief Minister's residence someone's private residence? In what capacity was he stopping them? We do not think that he is even ashamed of his act. The court said that we grant bail to contract killers, murderers as well, but how was morality ignored in this case.
Earlier, the Delhi High Court had rejected Bibhav Kumar's bail plea on July 12. Before that, the Tis Hazari Court had said that the investigation in this case is in its initial stage and the victim is worried about her safety. The Tis Hazari Court had said that Swati Maliwal is an Aam Aadmi Party MP and had gone to meet her party's Chief Minister Arvind Kejriwal. The court had said that there is also a possibility that if Bibhav Kumar is granted bail, he may influence the witnesses.
Delhi Police arrested Bibhav Kumar on 18 May. In this case, Swati Maliwal recorded her statement in the court on 17 May. The incident took place on 13 May. Delhi Police recorded Swati Maliwal's statement on 16 May and filed an FIR. Bibhav Kumar has already filed another petition in the Delhi High Court, challenging his arrest. The High Court has reserved the decision on this. Bibhav Kumar has challenged his arrest and demanded compensation. Bibhav Kumar has said that Section 41A of the Criminal Procedure Code was not followed while arresting him.
