Big blow to Nitish government in Bihar, 65 percent reservation banned

New Delhi: Nitish Kumar government of Bihar has got a setback from the Supreme Court. In Bihar, the government had increased the percentage of reservation for SC, ST and OBC from 50 percent to 65 percent, which was stayed by the Patna High Court. The Supreme Court has considered this stay of the Patna High Court as correct. At present, no relief has been given by the Bihar government in this matter. The Bihar government had decided to increase the 50 percent reservation to 65 percent in November last year. Later, the Patna High Court stayed it. The Bihar government had also passed a law for this reservation. The decision to increase this reservation was taken by the state government on the basis of caste-based census conducted in Bihar last year. The Bihar government challenged the stay of the Patna High Court in the Supreme Court.

Advocate Shyam Diwan, appearing on behalf of the state government, requested the Supreme Court to stay the High Court order. Earlier, the Supreme Court had stayed the order of the Chhattisgarh High Court. Apart from this, a request was also made to send notice to those who had appealed in the Patna High Court against increasing the reservation. Chief Justice of the Supreme Court D.Y. Chandrachud said that we will not give any stay order on the order of the High Court. Further hearing in this case will be held in September. Earlier, the Patna High Court had stayed the order and said that no state can increase or decrease 50 percent reservation. The Patna High Court had declared the decision of the Bihar government unconstitutional.
