HC summons: Gujarat High Court has issued summons to BJP MP Mukesh Dalal, who won the election unopposed from Surat Lok Sabha seat. He has to file his reply by August 9. Four Congress members have filed a petition challenging the decision to reject the nomination of party candidate Nilesh Kumbhani for Surat Collector and Returning Officer.
Mukesh emerged victorious on 22 April.
Petitioners' lawyer PS Champaneri said on Sunday that the court headed by Justice JC Doshi has issued summons to MP Mukesh Dalal and directed him to respond by August 9. The case was heard on July 25. Let us tell you that on April 22, Mukesh Dalal was declared the winner after the nomination of Congress candidate Nilesh Kumbhani was rejected and other candidates withdrew their nominations. This day was the last date for withdrawal of nominations.
How was the nomination rejected?
In fact, the nomination of Congress candidate Nilesh Kumbhani was rejected because of this proposal. His supporters filed an affidavit saying that they had not signed the papers. The nomination of Kumbhani's dummy candidate Suresh Padsala was also rejected for the same reason.

The petitioners have claimed that Kumbhani's three proposers had declared in their application before the deputy collector that they would sign his nomination papers as proposers. The petition argued that it is not the collector's job to verify the signatures.
This decision has been questioned because
The petition states that being a national party, the Congress has no dearth of proposers for its candidates in any constituency. Both the petitions question the returning officer's decision to reject Kumbhani's nomination under the provisions of Section 36 of the Representation of the People Act.
BJP has captured 25 seats and Congress has captured one seat.
Voting for 25 Lok Sabha seats in Gujarat was held on 7 May. When the election results were declared on 4 June, BJP got 25 seats and Congress got only one seat. Mukesh Dalal is the first leader to win the Lok Sabha elections unopposed in the last 12 years. He has become an MP for the first time.
