Supreme Court News : The Chief Justice of the country D.Y. Chandrachud was asked a question about the arrests of journalists, activists, leaders due to political pressure in the country. In response to which the Chief Justice said that not getting bail in cases of arbitrary arrest is worrying, he said that despite being eligible for bail in the trial court, bail is not granted, later one has to appeal in the High Court and if bail is not granted there also, then one has to come to the Supreme Court. Due to which there is a delay in such cases and the applicant also has to face trouble.
Addressing an event in Bengaluru, Chief Justice DY Chandrachud also gave some advice to the judges, saying that when important aspects of the crime are looked into doubt, trial judges prefer to play safe by not granting bail. Judges should use strong common sense by carefully examining each case. Cases in which bail should be granted in the trial court itself reach the Supreme Court after the High Court. Judges should take decisions independently.
Addressing the 11th Annual Conference of the Berkeley Center on Comparative Equality and Anti-Discrimination, Chief Justice Chandrachud was asked by a member of the audience whether the arrests were arbitrary or politically motivated. One member of the audience asked that we live in a society where a person first commits an act and then apologizes for it. This appears to be true when political pressure leads to the arrest of activists, journalists and opposition leaders, including some opposition chief ministers. All these actions are done with the belief that justice will be delayed.
Responding to this question, the Chief Justice said that we have to learn to trust those who are part of this legal system. We have to motivate the lower courts to take into account the concerns of people seeking bail. Judges should decide independently whether the applicant is eligible for bail or not.
