Bhopal, July 27 (HS). Senior Supreme Court advocate and constitutional expert (PIL man of India) Ashwini Upadhyay said that India's problems are not universal and incurable. They can be solved. For this, strict laws are required. Problems like hoarding, bribery, infiltration, encroachment are only in India. Giving the example of China and Dubai, he said that these countries do not have such problems because the laws there are strict. India's problems will not end with the laws made by the British. One country one law is necessary in India. First of all, we have to understand the difference between religion and sect. Even our educated people do not know what is religion and what is sect. Religion unites and sect divides. Hinduism is religion and everything else is sect.
Ashwini Upadhyay was addressing as the keynote speaker a one-day symposium organized by Hindustan Samachar News Agency and Dharma Sanskriti Samiti on land encroachment and uniform civil code in the capital Bhopal on Saturday. Talking about land encroachment, he said that many times we justify wrong things. It is said that this mazaar or cemetery is illegal. This means that some mazaars are also legal. Then why is there no mazaar or permanent cemetery in Arab countries. He said that making permanent mazaar or cemetery is haram in Islam.
Giving an example, he said that there is no such disease in India for which there is no medicine, no such problem for which there is no solution, but we only talk about problems. There is a flood of problem-mongers in India. Our Constitution talks about sovereignty. It defines Uniform Civil Code i.e. Article 44, but I talk about One Country One Law i.e. Article 15, which prohibits discrimination on the basis of caste, religion, language, region, place of birth. It is clear from reading the Constitution as it is that equality, parity, harmony, equal opportunity and equal rights are the soul of the Indian Constitution. Some people oppose 'Uniform Civil Code or Indian Civil Code'. But the truth is that most people are not aware of its benefits. Only converted Hindus will benefit from the implementation of Uniform Civil Code.
Upadhyay said that India is a country of gods and goddesses. Lord Shri Ram, Shri Krishna, Gautam Buddha, Vivekananda and all saints and great souls were born in India. In almost any program, we say that Dharma should be victorious, Adharma should be destroyed, there should be harmony among living beings and there should be welfare of the world. The most important among these is the destruction of Adharma. By praising Dharma, Adharma will not be destroyed, rather if Adharma is destroyed, then Dharma will be victorious. But we have stopped destroying Adharma. Destroying Adharma is not our job. When someone is murdered, we start Justice for Justice campaign. We are demanding justice for each person, but no one has got justice. For this, the system will have to be changed.
He said that the judiciary, the executive, the government and the media, all four have to work for the victory of religion. They should work to destroy irreligion, to bring goodwill among living beings and to do good to the world. Just as there cannot be victory of religion without the destruction of irreligion, similarly without strict laws, land encroachment cannot be stopped. It is not the job of society to stop land encroachment. There should be values in education and there should be fear of law. In Japan and Singapore, there are values in education and there is fear of law. In India, there is so much difference between these countries that you would have never heard of illegal construction there, but it is not so here. Here, the education system is running like that of the British era. Changes in the laws of the British era are necessary.
He said that it is written in the Constitution of India that we will create a sovereign India, but there was no discussion in our Parliament and Vidhan Sabhas on what the Constitution says. Lies are so prevalent in this country that those who have torn the Constitution to shreds for 75 years, working against the Constitution, are roaming around with the Constitution and those who are working to save the Constitution are being declared anti-Constitution. Sovereign India means independent India, that is, our India. Education, law and order, political system, everything should be ours.
He said that 300 schemes are running in India to promote religious conversion. Hindus of India think that there is no benefit in remaining a Hindu. There is benefit in converting religion. Conversion is happening with the money from our taxes and the money from temples. In India, the government has rights over the property of temples and monasteries worth more than one lakh crore, but the government has no control over any mosque or church. Giving an example, he said that until the Minority Commission is abolished, the problem of religious conversion will not end.
