Kolkata, 22 July (HS). Governor CV Anand Bose has sent a letter to two Trinamool MLAs, Sayantika Banerjee and Rayat Hussain Sarkar, terming their swearing-in as unconstitutional. The Governor has mentioned a total of 37 issues in his letter and clarified that the Speaker does not have the right to administer the oath by ignoring the Governor.
Governor Bose has written in his letter that he will have to give information about who administered the oath to Sayantika and Reyat. He also said that if the Deputy Speaker did not administer the oath, it is against the Constitution. In this case, a fine of Rs 500 can also be imposed on the two MLAs.
Speaker Biman Banerjee had administered the oath to Sayantika and Reyat on July 5, while the Governor had entrusted this responsibility to Deputy Speaker Ashish Banerjee. The Governor said that the oath taking of the MLAs, not following the Governor's instructions, is against the parliamentary process and constitutional provisions.
In this regard, Sayantika said that she will inform the speaker about this matter. Meanwhile, Speaker Biman Banerjee said that the Governor's instructions could not be followed as the assembly session was going on. He administered the oath to Sayantika and Rayat under Chapter 2, Section 5 of the 'Rules of Business'.
This controversy may escalate further in political circles as the Governor has called it a serious constitutional issue and has warned of action against it.
