Schools cannot force children to bring transfer certificates (TC or LC) from their previous school. The Madras High Court gave this order to the Tamil Nadu government on Friday. The court said that TC is mostly used by schools to collect outstanding fees.
The court said that the state government should issue a circular and tell the school management not to force children to bring TC from the previous school. In fact, for admission in any new school, the student is asked to bring the TC of the last school he went to. The bench of Justice SM Subramaniam and Justice C Kumarappan said that schools should not write unnecessary things in the transfer certificate of a student. Like many schools write that the fees have come late or some amount is due. The court said that the state government should consider this issue and if necessary, it should also change the Tamil Nadu education rules. The court said that it is wrong to force a child to bring TC or to write unnecessary things in his TC.
TC is not a fee collection tool
The court said that the transfer certificate is not a means to recover the outstanding amount from the children. It is a personal document, which is issued in the name of the children. Schools should not impose their problems on any child and should not write anything like fee payment or late fee on their transfer certificate. The bench said that it is the responsibility of the parents to pay the school fees. According to the rules, the schools will have to collect that amount from the parents.
