Supreme Court will hear the petition against passing the law bypassing Rajya Sabha

New Delhi: A petition has been filed in the Supreme Court against passing laws like the Aadhar Act as a money bill. The Supreme Court is ready to hear this petition. On the petition of Congress leader Jairam Ramesh, lawyer Kapil Sibal demanded a constitutional constitution. Chief Justice D.Y. Chandrachud showed readiness to consider it.

The petitioners, which also include Congress leader Jairam Ramesh, have argued that since the NDA does not have a majority in the Rajya Sabha, it is bypassing the Rajya Sabha by introducing bills like Aadhaar Act, amendment to Money Laundering Act etc. in the Money Bill, which is unconstitutional. In the 245-seat Rajya Sabha, the BJP has 86 MPs while the ruling NDA has 101 MPs, which is 123 short of a majority. Petitioner Kapil Sibal, counsel for Chief Justice D Y Chandrachud requested that the arguments have been completed, the dates for hearing on the petitions have not been fixed yet.

In response, the Chief Justice said that we will think about hearing by forming a constitutional bench. Later, the Congress welcomed the decision of the Supreme Court. Notably, the money bill is a part of the law, which is introduced only in the Lok Sabha and does not require the approval of the Rajya Sabha. The Supreme Court has also been asked to examine any such law passed by the government.
