30 army soldiers are in trouble, Supreme Court will hear the murder case

Case will be filed against 30 army personnel in Nagaland On Monday, the Nagaland government filed a writ petition in the Supreme Court. In which the state government challenged the decision of the central government under which action against 30 army personnel was banned. Nagaland Police has filed an FIR against these soldiers for killing 13 civilians during an operation to curb terrorist activities.

State Advocate General presented

Filing the petition, state Advocate General JB Pardiwala said that the police has important evidence that can prove the allegations against these jawans. The central government is taking arbitrary action and preventing them from being prosecuted and the deceased from getting justice.

Dissatisfaction of Nagaland government in this matter

In this regard, the Nagaland government said that the team sent by the central government neither looked at the evidence collected by the Special Investigation Team (State Police) nor investigated properly. They prepared their report arbitrarily and issued an order not to take any action against these army personnel.

In response to the petition, a bench headed by Chief Justice DY Chandrachud issued a notice to the Central government and the Ministry of Defence to file a reply within 4 weeks.

What was the matter?

30 army personnel including an officer have been accused in the case of the mistaken attack by army personnel in Nagaland in the year 2021. The SIT investigation revealed that the soldiers did not follow the prescribed SOP during the attack, which led to the death of 14 civilians who were returning home in a pickup truck at night. This led to a lot of controversy and uproar.

The state government said that the army opened fire on a car carrying coal mine workers without any inquiry. In which a total of 6 people died. A statement issued by the army said, all these people armed with guns and dressed in black jumped out of the car immediately after seeing us. After the incident, a clash broke out between the nearby villagers and army personnel in which 7 civilians and a soldier were killed.

The state government says that the army personnel are not familiar with the area and it is common for them to roam around with guns. All the evidence collected by the special team of the state police was sent to the Centre.

In the year 2022, the Supreme Court banned action against these soldiers.

In July 2022, the Supreme Court stayed the action against these soldiers as the wives of these soldiers had filed a petition. They also demanded the quashing of the FIR, after which the Nagaland government tried to get approval from the Center, but the Center refused to give approval on February 28 last year. On Monday, the Nagaland government filed a writ petition in the Supreme Court. In which the state government challenged the decision of the central government.
