Central government issued notification on Constitution Assassination Day : The central government has announced to celebrate 'Samvidhan Hatya Diwas' on 25 June in memory of the Emergency. A notification has also been announced regarding this. The then Prime Minister Indira Gandhi, displaying her autocratic mindset, strangled the soul of Indian democracy by imposing Emergency in the country. Lakhs of people were put in jail without reason and the voice of the media was suppressed. The Government of India has decided to celebrate 25 June every year as 'Samvidhan Hatya Diwas'. This day will remember the invaluable contribution of all those people who suffered the inhuman pain of the Emergency of 1975.
When and how is an emergency imposed?
Under Article 352 of the Constitution of India, the President has the right to declare a national emergency. The declaration of emergency is also made through the written recommendation of the cabinet headed by the Prime Minister. Under this, all the fundamental rights of the citizens are suspended. When there is a situation of famine, foreign invasion or internal administrative anarchy or instability etc. in the entire country or in any state, then all the political and administrative powers of that area are transferred to the hands of the President. Emergency has been imposed in India three times so far under Article 352 in 1962, 1971 and 1975.
1975 Emergency was declared
It is worth noting that the declaration of Emergency in 1975 was made after the decision of Allahabad High Court. The High Court gave its decision on 12 June 1975 on the petition challenging the election of Indira Gandhi. The High Court cancelled the election of the then Prime Minister Indira Gandhi from Rae Bareli and also banned her from contesting elections for the next 6 years. After this, there was a demand for the resignation of Indira Gandhi and agitations started taking place in various places in the country.
The Supreme Court upheld the order of the High Court
The Supreme Court also upheld the High Court's order. After this, Emergency was declared. Political parties keep attacking the Indira government and Congress and call it an undemocratic decision. Questions were raised on the circumstances under which the Emergency was declared and the way Prime Minister Indira Gandhi gave this information. Many organizations came forward calling the Indira government's decision dictatorial and massive protests started.
