Jaipur, July 8 (HS). Rajasthan High Court has put an interim stay on removing the block coordinator working on contract under the Panchayati Raj Department and appointing another contract worker in his place. Along with this, the court has given a copy of the petition to the state's Additional Advocate General Kapil Prakash Mathur and asked him to submit a reply by July 15. The single bench of Justice Mahendra Kumar Goyal gave the order while conducting the preliminary hearing on the petition of Ram Avtar Mehriya.
In the petition, advocate Ramakant Gautam told the court that the petitioner was appointed as a contract worker on the post of Block Coordinator in Ajmer district on July 1, 2022 through a placement agency. Since the appointment, he has been discharging his duties properly. Meanwhile, on June 6, the Local Development Officer terminated the services of the petitioner and issued orders to appoint another contract worker in his place.
Challenging this, it was said that there is no complaint about the petitioner working on the concerned post and he has completed his work properly. Apart from this, as per the rules, a contract worker can be removed from the post only when a candidate is not appointed on the concerned post through regular recruitment. In such a situation, a contract worker cannot be removed and another contract worker appointed in his place. Therefore, the order of removal of the petitioner should be cancelled. Hearing on which, the single bench has put an interim stay on the removal of the petitioner and asked the concerned officials to submit a reply.
