Jabalpur, July 03 (HS). The Madhya Pradesh High Court declared the complaint lodged by the woman in Bhopal's Piplani police station as false and cancelled the FIR. The woman had lodged a report against her alleged lover for raping her on the pretext of marriage.
While hearing the case, the court said that a married woman who is in a continuous relationship with another man cannot take the plea that the relationship was made by making a false promise of marriage. According to the petition filed, the woman was in a relationship with the alleged lover for 8 years. She often came to Bhopal from Lucknow to meet her husband and had a relationship with another man. Later she also lived with him for many years. In the meantime, when she divorced her husband, the alleged lover also left her. On this, the woman had lodged a case of rape against the alleged lover on the pretext of marriage in Piplani police station of Bhopal, which was rejected by the High Court.
During the hearing, the court said that consent cannot be considered as consent obtained on the basis of a false belief. The woman is already married so she cannot claim that consent for having a relationship was given under the pretext of marriage. Therefore, the FIR registered against the alleged lover is being cancelled.
