Home Minister Amit Shah said that these laws have been made by Indians, for Indians and by the Indian Parliament and they repeal the colonial era judicial laws. Under the new law, the verdict in criminal cases will come within 45 days of the completion of the trial and charges will be framed within 60 days of the first hearing.
New provisions for everything from rape to mob lynching
The statement of the rape victim will be recorded by a female police officer in the presence of her guardian or relative and her medical report will have to be submitted within seven days. The laws define acts of organised crime and terrorism, replace sedition with treason. Apart from this, provisions like mandatory videography of the crime scene of all heinous crimes have been included. Apart from this, death penalty has also been provided in cases of mob lynching.
Many new provisions were also added
The new law adds a new chapter on crimes against women and children, makes child trafficking a heinous crime and adds death penalty or life imprisonment for gang rape of a minor. Cases like false promise of marriage, rape of a minor, lynching, snatching etc. have come to light but there are no special provisions in the current Indian Penal Code to deal with such incidents. He said that provisions have been made in the Indian Judicial Code to deal with them. In the new law, women, people below 15 years of age, people above 60 years of age and people suffering from disability or serious illness will be exempted from coming to the police station and they will be able to get police assistance at their place of residence.
What is the opinion of experts?
Legal experts have also given their opinion on these laws. Legal experts say that there are now big challenges for law enforcement agencies, judicial officers and legal professionals. These laws will affect a large number of citizens at some point in their lives. Many legal experts also argue that the new criminal law gives unbridled powers to law enforcement agencies without any checks and balances, which can also pose a threat.
What do opposition parties say?
Before the implementation of the new criminal law, many leaders including Bengal CM Mamata Banerjee had written a letter to the central government demanding to stop it. Many opposition parties including Congress are opposing this law. Opposition parties say that this law has been implemented without any comprehensive discussion. The opposition has demanded that Parliament re-examine the new criminal laws, claiming that they have set the stage for turning the country into a police state.
