Mumbai: The Bombay High Court expressed displeasure over the incomplete post-mortem report of Anuj Thapan, an accused arrested in the firing case at actor Salman Khan's house. Thapan died in police custody and the police claimed that he had committed suicide.
The Vacation Bench of Smt. Borkar and Justice Sundaresan read out the post-mortem report and noted that it did not contain crucial details like hanging marks on the neck of the deceased and any other injuries on the body.
Anuj's mother Rita Devi had filed a petition in the court demanding a CBI inquiry claiming that her son died due to police torture. Police claimed that Thapan ended his life by hanging himself. Thapan's mother claimed in the petition that Thapan was physically tortured by the police while in custody.
On Wednesday, the government lawyer presented the preliminary report of the CID investigation and also presented the post-mortem report. The report listed the cause of death as strangulation but some other details were missing.
Where is the picture of the noose around the neck? Is the mark diagonal or circular? The court said, death by strangulation can happen not only by hanging but also by strangulation.
The court said that the column to inform whether there were any other injury marks on the body of the deceased was blank. The report is incomplete and incomplete, the court said. The government lawyer told the court that the investigation team will question the concerned doctor. The court directed the petitioner to submit a copy of the report and scheduled further hearing in June.
A senior lawyer appearing for Salman Khat sought deletion of the actor's name from the list of respondents, claiming that the petitioner has not made any representation against the actor.
In this case, the actor himself is the victim and the firing happened at his house. He doesn't even know who is involved and who has been arrested. Wrongly adding the names of the respondents sends the wrong signal and wastes talent.
Evin's lawyer told the court that the petitioner has not sought any action or relief against Khan. The court noted. On 14 April, two men riding a motorcycle opened fire at Galaxy Apartment, Salman's residence in Ban Ra. A total of six people were arrested in this case. Police said that among these, Thapan committed suicide by hanging himself while in police custody.
