Supreme Court overturns Madras High Court's decision, says how can bail be granted in one and a half years despite terrorism charges?

PFI News: Eight members of the banned organization PFI were released on bail by the Madras High Court, this decision was later challenged in the Supreme Court. The Supreme Court also expressed surprise at the High Court's decision to grant bail. Because all of them are accused of terrorism and despite being in jail for only one and a half years, they have got bail. The Supreme Court has canceled the decision of the High Court and asked all the accused to surrender.

The Supreme Court bench of Justices Bela M Trivedi and Pankaj Mittal said that considering the seriousness of the crime and the period of only one and a half years spent in jail, the bail is cancelled. The court can interfere with the order granting personal liberty if the order is made on wrong grounds. A prima facie case is made out on the basis of evidence and other material presented before us by the investigating agencies.

The Popular Front of India was banned by the Central Government, during which members of the organization were arrested. A case was registered against him under UAPA. Eight members have been released on bail in this case. Later this decision was challenged in the Supreme Court. During the hearing in the Supreme Court, the court refused to accept the argument of the lawyers of the accused that personal freedom is paramount. And ordered to cancel the bail.

Earlier, in October 2023, the Madras High Court had granted bail and said that the investigators had failed to provide evidence or any other proof that any of the accused was involved in terrorist activities. After which the court granted bail.
