Jaipur, 18 May (HS). Rajasthan High Court has stayed the action of dismissing the candidate after two and a half months of appointing him to the post of assistant in Anganwadi center. Along with this, the court has issued notice to the Principal Secretary, Women and Child Development, Director, Deputy Director and CDPO, Aligarh and sought their reply in the matter. A single bench of Justice Sameer Jain gave this order while conducting preliminary hearing on the petition filed by Rukhsar Bano.
In the petition, advocate Laxmikant Sharma told the court that CDPO, Aligarh issued an advertisement on December 1, 2023, declaring Anganwadi center number four as reserved for the minority category. In which the petitioner applied for the post of assistant. The selection committee selected him after coming in preference. The CDPO issued his appointment orders on 26th February. After this the petitioner took charge on the same day. The petition said that on May 8, 2024, the CDPO terminated her service saying that the post of assistant is not reserved for the minority category. Which was challenged in the petition and said that reservation cannot be tampered with after the recruitment advertisement is issued. Apart from this, it is wrong to remove the petitioner after three months of service without giving him a chance to be heard. In such a situation, the order of termination of the petitioner's service should be cancelled. Hearing which, the single bench has stayed the dismissal order and issued a notice to the concerned officers and sought their reply.
