New Delhi, May 14 (HS). Delhi High Court has convicted the accused of raping his 10-year-old daughter for two years. A bench headed by Justice Suresh Kait will hear the sentence period on May 24.
The court said that the victim girl might have thought that she would find a refuge in the lap of her father but she did not realize that he was a monster. The High Court canceled the trial court's order acquitting the accused and declared him guilty. The court convicted the accused under Section 6 of the POCSO Act and Section 506 and Section 323 of the Indian Penal Code.
The incident occurred on January 19, 2013, when a 12-year-old girl reached Patel Nagar police station and narrated her ordeal. According to the victim girl, her father raped her for two years. His father was drunk on January 18, 2013. When his mother returned home, his father abused him. The next day her brother was also beaten up, after which the victim reached the police station.
On the issue of acquittal of the accused by the trial court on the basis of delay in giving information about the case, the High Court said that there is no reason to doubt the statement of the victim. The High Court said that the statements of three witnesses in this case tell the entire incident. The High Court rejected the argument that this was a well-planned case.
According to the victim girl, her parents used to work as security guards. One day his father was out of job and his mother had gone for duty and his brother had gone to school. That day his father stopped him from going to school. The father called the victim next to him, made her sleep and started touching her private parts, to which she protested. When he protested, his father scolded him. He told this incident to his mother, after which the mother asked the father. Then the father scolded the mother also. The father scolded the girl for telling everything to her mother. After that her father continued to sexually exploit her. In this case, the prosecution had recorded the statements of 13 witnesses.
