After the Bombay High Court declared the arrest of Chanda Kochhar and her husband Deepak Kochhar illegal in the loan fraud case, the court on Monday said that the CBI arrested Chanda and Deepak without using common sense and without respecting the law. Kochhar was arrested. , The court also held that the arrest was an abuse of power. A division bench of Justice Anuja Prabhu Desai and Justice NR Borkar had on February 6 declared the arrest of former ICICI Bank managing director and chief executive officer Chanda Kochhar as illegal. Also, in January 2023, another bench confirmed the interim order granting him bail. Now the court has said that the CBI has been unable to present supporting material as to the circumstances on the basis of which the arrest was made. Such circumstances make the arrest illegal.
Court rejected CBI's argument
The court also refused to believe the investigation agency's contention that the arrest was made because Kochhar was not cooperating in the investigation. In response, the court said that the accused have the right to remain silent during interrogation. It is noteworthy that CBI had arrested Chanda Kochhar and Deepak on 23 December 2022 in the Videocon-ICICI Bank loan case. However, the court had granted bail to Chanda Kochhar in an interim order on January 9, 2023.
