A petition has been filed in the Supreme Court against Manan Kumar Mishra, Chairman of the Bar Council of India (BCI), the country’s top legal body, challenging his long tenure and continuation in the post. Meanwhile, amidst all the protests and demands for resignation, Manan Mishra has made it clear in clear words that he will not resign from his post.
What is the whole controversy and the petition in the Supreme Court?
This entire controversy started with the uproar created after Chief Justice of India Surya Kant was invited to the convocation ceremony of NALSAR University of Law, Hyderabad. In this case, the BCI President had earlier given an order to cancel the enrollment of the students, which was withdrawn within 15 minutes.
After this, a petition was filed in the Supreme Court through lawyer Deepak Prakash, in which it has been alleged that Manan Mishra continuing as BCI President for more than a decade is against the rules. Citing Rule 12(2) of the BCI rules, the petition has challenged the notification dated April 21, 2025, through which his tenure was extended.
‘I have come from the elections, I represent 25 lakh lawyers of the country’
After the petition was filed in the Supreme Court and lawyers demonstrated in Delhi, Manan Mishra openly presented his side in front of the media. He said that he is not on any nominated post, but has reached this post through the democratic process and elections.
He clarified that BCI is a legal body representing about 25 lakh lawyers in the country. According to him, this is his seventh term and the last six times he has been elected unopposed. Even today, more than two-thirds of the Bar Council members are with him. He termed all the allegations of financial and family appointments leveled against him as baseless and said that he will remain in office as long as the lawyers of the country i.e. the voters want so.
