District Consumer Commission, II has held the Santokba Durlabhji Hospital administration and its three doctors guilty in the case of depriving motherhood of happiness due to premature delivery due to medical negligence. Along with this, the Commission has imposed a compensation of Rs 9 lakh on the hospital administration. The Commission has also imposed a compensation of Rs 2 lakh each on Dr. Fayaz, Dr. Riddhima and Dr. Priyanka. The Commission said that the total amount of Rs 65 thousand spent on the treatment of the complainant should also be returned along with interest. Commission Chairman Gyarsi Lal Meena and member Hemlata Aggarwal gave this order while hearing Jaya's complaint.
In the complaint, advocate Vipul Sharma told the Commission that on August 13, 2010, the complainant was 21 weeks pregnant. The complainant was admitted to Durlabhji Hospital late on the night of 20th August. Where he was not treated on time. The complainant's uterus was not treated even after it was opened and when Dr. Fayaz arrived at around ten in the morning, she was informed that the child had died due to premature delivery. After this, the investigation report was not even given to the complainant. The complainant returned to Mumbai after discharge. Where sonography done in October 2010 revealed that remnants of a previous pregnancy were present in the uterus. From which it is clear that there was negligence in his treatment at Durlabhji Hospital. In such a situation, he should be given compensation. Many arguments were given in its defense by the hospital administration and doctors, but the Commission did not accept them. Along with this, the Commission has imposed damages on the hospital and doctors.
