
Chief Justice of India Surya Kant has given a powerful message regarding justice system and equality from the platform of the prestigious ‘St. Petersburg International Legal Forum’ held in Russia. He clarified that the first and most important step to walk on the path of justice is to ensure ‘Equal Access to Justice’. In his address, the CJI emphasized that equality before law should not be limited to mere paperwork or procedural formality, but should reach the general public in the form of real rights.
Origin of equality and foresight of Kautilya
During his speech, CJI Surya Kant offered a fresh perspective on the historical context of equality. He said that the principle of equality across the world is often attributed to the Magna Carta of 1215, but from his personal belief and research it is clear that its basic principles lie in the great fourth century text of the Indian subcontinent, ‘Kautilya’s Arthashastra’. He said that the Indian Constitution also carries forward this legacy, which promises a dignified life, equality before law and justice to every citizen.
Global South and challenges of justice
Talking about the international legal framework, the CJI said that many countries in the Global East and South are still in the process of strengthening their institutions. These countries face major challenges like the impact of colonial history, poverty and social inequality. He reminded the global community that strengthening the judicial systems of these emerging countries is essential to building a just world. Equal access to law is the only medium through which the foundation of democracy can be strengthened and the last person of the society can be connected to the mainstream of justice.
