The history of labor courts in Jharkhand is going to change.
After the new rules of the Central Government, now the state 13 Labor Courts renamed as ‘Industrial Tribunal’ Is being done.
Who will sit on the judge’s chair now?
The biggest and shocking change has happened not just in the name, but in the people who give the decision.
Till now the arrangement was that in Labor Court only A Presiding Officer There were those who came from the judiciary i.e. the class of judges.
But, according to the new rules now ‘Industrial Tribunal’ If formed, it will have a bench of two members:
- Judicial Member: This will be the same old judge (of High Court or District Judge level).
- Administrative Member: This is a new entry. Now senior government officials (Labor Department officials like Joint Labor Commissioner etc.) will also sit on the bench and give the verdict.
What does it mean?
If we understand in simple language, now the government (administration) will also have direct participation in court decisions. The government’s argument is that by doing this the workload will be distributed and Labor Department officials understand the technical issues better, which will make the decision practical.
Will the workers get justice soon?
There is a pile of cases in the labor courts in Jharkhand. The real purpose of this new system is said to be that the disposal of cases should be faster. However, some experts are also worried in hushed tones that with the arrival of the administrative officer, the ‘system’ might get inclined towards the government or the planners. Because judges are completely independent, while officers are subordinate to the government.
Effect of new labor code
Let us tell you that the Central Government has abolished 44 old labor laws. 4 new ‘labor codes’ Have made. Under this, Jharkhand government is changing its rules. As soon as the approval of the state cabinet is given, this old system will become history and the new system will be implemented.
