No renewal of liquor shops without the wish of the licensee – High Court

Jaipur, 1 April (HS). The Rajasthan High Court has said that there is no provision under the Excise Act or other rules that the liquor shops of the licensees can be renovated without their wish. Along with this, the court has put an interim stay on the implementation of the March 13 order issued by the department in this regard. A single bench of Justice Mahendra Kumar Goyal gave this order on the petitions filed by Krishna Sharma and others. The court has made it clear in its order that this stay will remain only in the cases of the petitioners.

In the petition, senior advocate RB Mathur told the court that there are more than seven thousand five hundred liquor shops in the state. The petitioners had taken a license to operate the shop for the year 2023-24. More than four thousand shops have missed bids in this new financial year. The Excise Department also bid for the shops of the petitioners, but no one bid. On March 13, the department, citing the code of conduct, issued an order that the shopkeepers whose licenses were expiring on March 31, 2024, were being renewed for three months on the basis of the new rules. It was said in the petition that before issuing this order, the department did not know the side of the petitioner shopkeepers. Apart from this, the license cannot be renewed without their wish and they are also not willing to run the shop further. Hearing which, the single bench has put an interim stay on the implementation of the order of the Excise Department.
