Mumbai: The Sessions Court found the 51-year-old unemployed accused guilty and sentenced him to life imprisonment in the case of murder of a 59-year-old retired bank employee over a tenancy dispute in a building in Borivali. The daughter of the deceased was a witness in the case and testified about how her mother's hair was slashed with a knife.

In the evening, when the deceased Vanita Mendon and daughter Pooja Mendon returned from the market, accused Rajesh Rathore chased Vanita and murdered her.

Convicting Rathore, Additional Sessions Judge Datta Dhoble said that in view of the oral testimony and documentary evidence, it is proved beyond doubt that the accused has committed the crime. Mother and daughter lived in a rented flat. The landlord had purchased this flat from the brother of the accused. It is alleged that the accused objected to selling the flat. The government side claimed that the accused had surrendered before the police after committing the crime, while it told the court that he had been falsely implicated.

Of the 11 witnesses examined by the public prosecutor, two were neighbours, one of whom was an eyewitness and the other who had seen the accused with the knife.

According to the deceased's daughter Pooja, they lived on the third floor of Axar Neelkamal Society. This incident took place between 6.15 and 6.30 pm. She was returning from Borivali station market with her mother. He himself reached the third floor and mother was still below. The door of the flat was about to open when mother screamed and she went down. She saw the accused holding her mother's hair in one hand and a knife in the other hand. He was asking for property documents from his mother. Pooja and her mother asked her to talk to the agent. As soon as Pooja and her mother reached the flat, the accused followed them. A neighbor tried to stop him but he threatened her. After opening the door of Pooja's flat, the accused stabbed her mother twice in the chest.
