The bench of Chief Justice Gawai and Justice Augustine George Christ is hearing several petitions challenging the constitutional validity of the Waqf (Amendment) Act, 2025.
Hearing the arguments of the petitioners, Chief Justice Gawai said, “There is a notion of constitutionality of this law and the courts cannot intervene until a clear case comes up.” Currently, the petitioners are presenting arguments before the bench. The central government will present arguments after the petitioners.
Senior advocate Kapil Sibal, who argued on behalf of the petitioners challenging the constitutional validity of the law, argued that the law is for the protection of the Waqf, but the purpose is to capture the Waqf and it is designed in such a way that the Waqf property is taken away without following any procedure.
“The Act is for Waqf protection, but its purpose is to capture the Waqf. The law is made in such a way that the Waqf property should be taken away without following any proper procedure.
