Lok Sabha Elections 2024: While announcing the schedule of Lok Sabha elections last week, the Election Commission had said that it will take all possible steps to ensure fair elections. Under this, the Election Commission took major action on Monday. The Election Commission has issued an order to remove the Home Secretaries of six states. Apart from this, orders have also been given to remove the Director General of Police (DGP) of West Bengal. This decision was taken in a meeting by Chief Election Commissioner Rajiv Kumar (Chief Election Commissioner of India Rajiv Kumar) and Election Commissioners Gyanesh Kumar and Sukhbir Singh Sandhu.
The Election Commission has given instructions to remove the Home Secretaries of Gujarat, Uttar Pradesh, Bihar, Jharkhand, Himachal Pradesh and Uttarakhand. Apart from this, orders have also been given to remove the General Department Secretary of Mizoram and Himachal Pradesh. That is, the Election Commission has removed these officers from their posts till the nomination, voting and results are declared. Each of these officers will be reinstated to their respective posts after the declaration of Lok Sabha election results.
After the announcement of elections, when the Model Code of Conduct comes into force in the country, the question arises that how does the Election Commission get the right to remove senior officials. The Election Commission has been given powers in the Constitution itself.
The Election Commission has been constituted under the Constitution of the country. It is a constitutional institution. Article 324 of the Constitution of India elaborates on the functions of the Election Commission. Article 324 mentions the fair and free conduct of elections and electoral rolls. The powers given to the Election Commission under the Constitution include the right to conduct Lok Sabha, Assembly and other elections in a transparent manner as per the law. The commission works in coordination with law enforcement agencies to conduct elections.
What are the duties of the Election Commission?
The Constitution of India empowers the Election Commission to deploy security forces to maintain law and order. So that any kind of election violence, booth capturing and pre-election corruption can be stopped. The Commission deploys paramilitary forces, local police and armed police for this. Apart from this, the Election Commission also deals with CCTV, videography, webcasting at polling stations and irregularities during elections, security of voters and polling officials. Not only this, but in elections that are held near the borders, the Election Commission coordinates with law enforcement agencies to prevent any untoward incident across the border.
