The Supreme Court on Tuesday took a negative view on the vacancies in the Central Information Commission (CIC) and State Information Commissions (SIC) and directed the Center to fill the posts immediately. A bench of Justices Surya Kant and N Kotishwar Singh asked the Center to immediately appoint information commissioners in the CIC as the posts need to be filled at the earliest.
Otherwise, what is the point of having an organization if we do not have people working for it? The bench criticized the selection of only a particular category of candidates in the CIC and SIC and took into consideration the judicial commentary on the presence of bureaucrats in these commissions and not people from all walks of life. Justice Surya Kant said, we can take judicial cognizance of the fact that only one caste is working in the entire commission. Why appoint only bureaucrats and not appoint people from many fields. We do not want to say anything more on this issue, but it needs to be considered.
States delayed the selection process
Advocate Prashant Bhushan, appearing for petitioner Anjali Bhardwaj and others, said that in 2019, the Supreme Court had issued a concrete order to fill the posts in CIC and SIC, but the states delayed the selection process and almost ignored the RTI Act. Did it. Requesting the court to summon or respond to the secretaries concerned, the counsel said that due to vacancies, people using this platform face immense difficulties and the failure of the State Governments to appoint people has violated the provisions of the Act. The original purpose has been defeated.
