High Court strict on government's absence in cases, seeks affidavit from CS within 8 weeks – News India Live

Jaipur, March 14 (HS). Rajasthan High Court has expressed strong displeasure over no one coming to represent the government in its cases and has sought a reply from the Chief Secretary. Along with this, the Chief Secretary has been asked to submit an affidavit within 8 weeks. Justice Ashok Kumar Jain gave this order when no one was present from the corporation's side during the hearing on the case related to Jaipur Municipal Corporation. The court said that despite the notice being served, no one from the corporation came and the corporation comes under the definition of the government.

This case came to the court about seven years ago, in which the decree order of the Jaipur Metropolitan District Court was challenged. The matter reached the Supreme Court, from where the High Court was ordered to give its decision before 28 February 23. Last year, no one appeared in this case on 21st February and 24th March and when no one appeared on 11th May also, the case was finally dismissed. When the application for its restoration was not presented, the other party recently requested for payment of interest of Rs 1 crore 23 lakh 21 thousand 611 as fixed in the decree by the subordinate court. On this, a notice was issued to the Municipal Corporation and the notice was also received by the Corporation, but no one appeared. Regarding this situation, the court commented that it seems that there is a flaw in the government's system regarding litigation. It has been seen that the government makes appeals and revisions every day and when no one comes, they are rejected. This causes loss to the state, for which government employees and the political representatives running the government are responsible.
