An important hearing was held in the Supreme Court on Friday on the Shahi Jama Masjid case in Sambhal city of Uttar Pradesh. Meanwhile, the Supreme Court stayed the proceedings of the lower court in this case.
Now the lower court cannot take any action in this matter until the petition of the Muslim side against the survey of the mosque is listed for hearing in the High Court. Sambhal Shahi Jama Masjid Committee challenged the decision of the lower court in the Supreme Court. The Supreme Court directed the mosque committee to approach the High Court and also directed the High Court to list the mosque committee’s application within three working days. Chief Justice Sanjiv Khanna and Justice P.V. Sanjay Kumar’s bench also ordered that the survey commissioner’s report be kept in a sealed cover. On the orders of the lower court, the Advocate Commissioner had conducted a survey of Jama Masjid, the survey report of which was to be filed in the court today, but till now the report has not been presented in the court.
Peace and harmony should prevail in Sambhal
The lower court of Sambhal had ordered the survey of Jama Masjid on November 19 last. On the orders of the court, the Advocate Commissioner surveyed the mosque. On November 24, violence broke out during the survey in which five people were killed. The Mosque Committee had filed a petition in the Supreme Court on this issue, hearing which the Supreme Court said that peace and harmony should be maintained in Sambhal. The court told Additional Solicitor General KM Natarajan, appearing on behalf of the UP government, that we have to maintain peace and goodwill. We have to remain completely neutral and ensure that nothing wrong happens.
Stay on action of lower court: The lower court will not take any action in the Shahi Masjid case. The Supreme Court has given a stay against it. The proceedings in the lower court will start only when the Allahabad High Court lists the petition of the Muslim side and starts the hearing.
The case will go to High Court The Supreme Court has asked the Mosque Committee to go to the High Court. The court said that the committee should first challenge the decision of the lower court in the High Court. The Supreme Court directed that the committee’s petition be heard within three working days of its filing.
No bar on filing survey report: The Masjid Committee wanted to direct the Advocate Commissioner to stop filing the survey report, however, the Supreme Court clarified that the filing of the survey report cannot be stopped but it will be kept in a sealed cover and will not be opened now.
Hearing in January: The Supreme Court has not yet given any decision nor given any opinion on the petition of the Mosque Committee. The committee’s next petition will be heard next January.
