High Court angry over pending investigation in Economic Offenses Wing of UP Police, seeks answer from DGP

Prayagraj, 13 November (HS). Allahabad High Court has expressed displeasure over the delay in investigation of many cases being done by the Economic Offenses Wing (EOW) of Uttar Pradesh Police. The Court observed that investigation cases by EOW are kept pending for years.

The court directed Director General EOW (Prashant Kumar-1) to file his personal affidavit by December 16. Said to explain why the branch is lagging behind in investigation. Also asked about its reasons, responsible persons and steps taken for speedy disposal of the investigation. The court has also sought reply from UP DGP.

This order was given by the bench of Justice Samit Gopal while hearing the anticipatory bail petition filed by Mohammad Harun. In 2019, action was taken against Mohammad Harun in Meerut under the Prevention of Corruption Act. The accused filed anticipatory bail petition. During the hearing, the court found that the investigation of the case was pending for a long time. Another bench summoned the investigating officer along with the case diary and directed that its order be communicated to the Uttar Pradesh DGP. In March this year, the court had given four weeks time to the state to file a counter affidavit in the case.

When the matter came up for hearing before the bench of Justice Samit Gopal, he found that the state government had not yet filed any reply. The state counsel also did not receive any response from the UP DGP’s office. The Court observed that investigations in the Economic Offenses Wing remain pending for years.

For this reason, the High Court has also sought an affidavit from the UP DGP. The date of hearing has been fixed for December 16. The Court also directed that in the event of arrest of the applicant till the next date or till the submission of the police report before the competent court, whichever is earlier, he would be released on interim anticipatory bail on a personal bond.
