The Supreme Court has given its verdict on the UP Madrasa Education Board Act 2004. The court has upheld the validity of the Madrasa Act. With this, the decision of the High Court has been put on hold. Earlier, on April 5, 2024, the Supreme Court had stayed the decision of the Allahabad High Court declaring the Madrasa Act unconstitutional. Answers were also sought from the Central and UP governments.

CJI says that UP Madarsa Act is not a violation of the Constitution. The decision of the High Court was not right. 16 thousand madrassas running in UP have got relief. Madrasa will continue. Let us tell you that the total number of madrassas in UP is around 23,500. Of these, 16,513 madrassas are recognized. This means that they are all registered. Apart from this, about 8000 madrassas are unrecognized.
The case was challenged in SC
On October 22, the Supreme Court said that 17 lakh students would be affected by the High Court's decision. Instructing students to transfer to another school is not appropriate. Religious education has never been a curse in the country. Let us tell you that the bench of Chief Justice DY Chandrachud, Justice JB Paridwala and Manoj Mishra had reserved its decision on October 22. Madrasa Azizia Ijajutul Uloom manager Anjum Qadri and others challenged the Allahabad High Court's decision in the Supreme Court.
Why did the UP government conduct the survey?
Let us tell you that the UP government had received information from social organizations and security agencies that madrasas are being run illegally here. Based on that, Uttar Pradesh Council and Minority Minister decided to conduct a survey. After this, a team of 5 members was formed in every district. This includes District Minority Officer and District School Inspector.
8441 madrassas unrecognized in survey
The survey of the madrasa was conducted from 10 September 2022 to 15 November 2022. The deadline was later extended to November 30. In the survey, about 8441 madrassas were found in the state which have not been recognized. Maximum 550 madrassas were found illegal in Moradabad, 350 in Basti and 240 in Muzaffarnagar.
100 madrassas of the capital Lucknow have not been recognized. Apart from this, more than 90 madrassas in Prayagraj-Mau, 132 in Azamgarh and 85 in Kanpur were found without recognition.
According to the government, there are currently 15,613 recognized madrassas in the state. In October 2023, the UP government formed SIT to investigate the madrassa. SIT is investigating foreign funds given to madrassas.

Some people believe that this law prevents madrassas from providing secular education.
