Mumbai: Bombay High Court has allowed an 11-year-old victim of sexual assault to carry on with her pregnancy for 30 weeks.
Mrs. A vacation bench headed by Sharmila Deshmukh and Smt. Jitendra Jain said that Sagira will have to undergo the abortion procedure at JJ Hospital on Thursday itself.
The girl's father filed an application in the High Court seeking permission for abortion. According to law, court permission is required for abortion after 20 weeks.
A case has been registered against unknown accused under POCSO and Indian Penal Code. The petitioner is a minor and a victim of sexual harassment. She is allowed to have an abortion.
Instructed to retain fetal blood and tissue samples for DNA or other tests for criminal prosecution. If the child is born alive then all medical facilities have to be made available to save his life.
If the petitioner or his father does not want to take responsibility of the child, then the government will have to take all the responsibility of the child, we also told the court.
