After hearing the PIL filed regarding student union elections in government universities and colleges, the High Court has disposed of the PIL on the basis of the government order of the state government. On behalf of the government, it was said that the government had issued a government order on 23 April 2024 saying that student union elections should be held by 30 September, but the universities did not comply with that order. Now the deadline for holding elections has passed, hence it is not possible to conduct student union elections.
On behalf of the petitioner, it was said that the government was not successful in implementing its own mandate. The Lyngdoh Committee report was violated. By not holding student union elections, their democratic rights are being violated. If the government wants, it can withdraw its order and conduct student union elections. It is clearly written in the report of the committee that elections should be held within eight weeks of admission, so that their studies are not affected later.
The case was heard before the division bench of Acting Chief Justice Manoj Kumar Tiwari and Justice Vivek Bharti Sharma. According to the case, Dehradun resident social activist Mahipal Singh had filed a PIL in the High Court on the basis of news published in the newspapers on October 25 that student union elections would not be held in state universities and colleges, saying that the state government had decided to hold an academic session on April 23, 2024. A calendar was issued in which instructions were given to hold the student union elections by 30 September 2024. Despite this, the university administration did not organize the elections on time nor did it receive guidelines from the government, which is a violation of the recommendations of the Lyngdoh Committee. This is affecting the studies of the students.
