Supreme Court on bulldozer action: The accused of Bahraich violence have filed a petition in the Supreme Court against the bulldozing action of the UP government and have demanded an immediate hearing on it. Senior advocate CU Singh said that a procession was taken out on October 13, after which this incident happened.
Application filed after receiving notice to demolish house
The petition has been filed by three people who have received notices to demolish their houses within three days. The father and brother of the petitioners have already surrendered before the police. Calling it a clear violation of court orders, Singh said, “PWD has issued the demolition notice in three days, while we are trying to bring the matter for urgent hearing.”
What did SSG say?
Justice Gavai asked, is this matter in the High Court? And are you aware of the court orders? And if you want to take the risk of disobeying these orders, that's your decision. Additional Solicitor General (ASG), appearing for the government, said, 'We have assured the High Court that a 15-day notice has been issued on October 20.'
Stay on proceedings till the hearing of the case
Counsel for the petitioners argued that our client should be given protection, because one house is 10 years old and the other is 70 years old. Justice Gavai said that according to the government report the house is located 30 kilometers away from the road. The court has ordered that the case will be heard tomorrow and no action will be taken till then.
The Supreme Court has ordered the UP government not to take any action till tomorrow. And now this case will be heard on Wednesday.
Let us tell you that on October 13 at around 6:00 pm, Ram Gopal Mishra, a resident of Rehua Mansoor village of Hardi police station area of Bahraich, had participated in the procession for immersion of the Durga idol. When the procession was passing through a particular community area in Maharajganj market, a fight broke out between the two parties. It is alleged that during this time stones were pelted from the roof, due to which a stampede occurred during the demolition. Meanwhile, Ram Gopal was shot from the roof of the house, due to which he died.
On the other hand, Lucknow Bench of Allahabad High Court on Sunday has banned running of bulldozers in Bahraich for 15 days.
