New Delhi: ( CM kejriwalgrant bail) Chief Minister Arvind Kejriwal has got bail in the liquor scam case. A two-judge bench gave its verdict on the bail of Chief Minister Kejriwal. The bench of Justice Suryakant and Ujal Bhuiyan had reserved the decision after hearing the arguments on the case on September 5.
During the hearing, both the judges expressed different opinions. Justice Ujjwal Bhuiyan also made an important comment on the action of CBI. He said that the notion of CBI being a caged parrot should be changed. Justice Bhuiyan also made this strong comment while raising questions on the timing of the arrest by CBI.
What did the court say about CBI?
Justice Bhuiyan of the Supreme Court said about the CBI that being the country's premier investigating agency, it should not be seen making arbitrary arrests. Rather, it should not be seen as a parrot in a cage and efforts should be made to remove any notion of bias.
The CBI is a premier investigating agency of the country. It is in the public interest that the CBI should not only be impartial but also be presented with a fair view. Every effort should be made to dispel the perception that the investigation was conducted impartially and the arrests were made in a partisan manner. Perception matters in a functioning democracy governed by the rule of law. The court said, “It is important that the perception of the CBI as a caged parrot should be eliminated.
What did Justice Suryakant say?
Along with this, Justice Suryakant has justified the arrest of CM Kejriwal. Justice Suryakant said that his arrest is not illegal. Freedom is a specific part of the judicial process. Keeping a person in custody for a long time is unjust. This is to deprive someone of freedom.
On what conditions did CM Kejriwal get bail?
The Supreme Court has released him from jail. The Supreme Court has granted him bail with certain conditions. According to the court, he cannot go to the Chief Minister's office. Also, he cannot contact witnesses. The third condition is that he cooperates in the investigation. The court has released him on a bond of Rs 10 lakh. He can neither go to the Chief Minister's office nor sign any file.
