Jaipur, March 5 (HS). The Rajasthan High Court has postponed for four weeks the hearing of the case related to the resignation and membership of 81 Congress MLAs during the last assembly. The division bench of CJ MM MM Srivastava and Justice Bhuvan Goyal gave this order on the petition of the then leader of opposition Rajendra Singh Rathore.
During the hearing, petitioner Rajendra Singh Rathod told the division bench that constitutional points have to be decided in the case. In such a situation, they have to discuss with constitutional experts. Therefore, time should be given to argue the case. On this, the court has fixed the hearing of the case after four weeks. On behalf of the petitioner, it was said that these MLAs tendered their resignations on 25 September 2022, which were rejected after a delay of 113 days. The then Speaker of the Assembly rejected the resignations saying that the MLAs had not given their resignations voluntarily. It was told on behalf of the petitioner that these MLAs received about Rs 18 crore as salary allowances from 25 September 2022. In such a situation, appropriate instructions should be given in this regard. At the same time, guidelines should also be given regarding the period for deciding the resignations pending before the Speaker of the Assembly. It is noteworthy that in the last hearing, a reply was presented in the court by the present Speaker of the Assembly saying that the then Speaker did not conduct any investigation regarding the resignations of the MLAs and rejected them as not voluntary.
