87 lakhs not given to teacher, Collector’s car and Zilla Parishad building will be attached

Bharatpur, 6 December (Hindustan Reporter). The city court has ordered to attach the vehicle of the Collector and BDO along with the Zilla Parishad building. ACJM Court has issued these orders for non-payment of about Rs 86.51 lakh to a teacher of the Education Department.

On the orders of the court, a notice of attachment was pasted on the Zilla Parishad building on Friday. Collector Amit Yadav and BDO were not found in their office. Because of this the notice could not be pasted on his car.

Mahesh Chand Sharma, a resident of Awar village of Bharatpur, was employed as a grade three teacher in the year 1990. The first posting was in the primary school of Kishanpura village in Kumher area.

After working for two years, in 1992, the then Block Development Officer (BDO) issued an order declaring Mahesh Sharma’s B.Ed degree to be fake and relieved him from the job without giving any notice.

The Education Department lodged an FIR against him in Kumher police station regarding fake degree. But, during investigation, the case was found to be false and he was acquitted by the court in the year 1994.

Mahesh Chand Sharma (64) told that in the year 1994 he sued the Education Department. It said that my degree is not fake. The action taken against me is wrong. This case took place in Court ADJ No. 1 of Bharatpur. The case was won in the year 2018.

The court ordered the Education Department to give all the benefits to Mahesh Sharma. The court ordered to give approximately Rs 86.51 lakh to Mahesh Sharma. Also said that he should be reinstated on the job.

The Education Department moved the High Court against this order in 2018. The education department’s appeal in the High Court was rejected. In 2022, the Education Department went to the Supreme Court against the High Court order.

There also the appeal of the education department was rejected. Also, the Supreme Court ordered that all the benefits be given to Mahesh Sharma within three months. But, the order of the Supreme Court was not followed.

Meanwhile, Mahesh Sharma retired in November 2020.

Mahesh Sharma’s lawyer Manish Sharma said that due to non-compliance of the order, a petition was presented in ACJM-01. The court ordered on Friday that the Zilla Parishad building, BDO’s vehicle and the Collector’s vehicle be attached.

Today a notice of attachment was pasted by the court on the Zilla Parishad building. The Collector had gone to Delhi. BDO was in a meeting somewhere. The PAs of both the officers have been informed about this. A notice will be pasted on his car on Monday.

In the notice, Zilla Parishad, Collector and BDO have been given 30 days time. If Mahesh Sharma is not paid within 30 days then auction action will be taken.

Advocate Manish Sharma told that before the year 2010, the primary section came under the Zilla Parishad. The Zilla Parishad CO used to be his appointing officer. After 2010, it was brought into the Education System (Education Department). Therefore the court had made the Zilla Parishad a party. The Collector is the head of the district. All the departments come under the Collector, hence the court made him a party.

Cell Amin of Bharatpur District Court, Vikas Anand Sharma said that I have received the warrant from ACJM I, Bharatpur. After this, under 21 Rule 54, I have attached the building of Zilla Parishad, Bharatpur. After that the vehicles of the officers will be confiscated under 21 Rule 30.
