Jaipur, 26 April (HS). The Supreme Court has refused to grant relief to 12 accused, including 11 trainee SI and one constable, in the SI Recruitment-2021 paper leak case. Along with this, the court has rejected the special permission petition of the accused. The court has asked the High Court to hear the case on May 1 on the fixed date. In the SLP, the accused had challenged the order of the High Court, in which the High Court had stayed the order of the Chief Metropolitan Magistrate releasing the accused.
It was said in the SLP on behalf of the accused that SOG has hidden the facts from the High Court. Release orders for the accused were made and the High Court has wrongly stayed their release. It will take time to hear the state government's petition, hence the High Court's April 15 order should be stayed and he should be released on bail. In response, Solicitor General Tushar Mehta and AAG Shivmangal Sharma, on behalf of the state government, said that the accused have come against the interim order of the High Court, the matter is pending in the High Court and hearing is to be held there. In this case, the CMM Court has directed to release the accused conditionally, which is wrong. The CMM court itself had earlier sent the accused on police remand. If he was in illegal custody, he should have been released at that time. If remand has been given once, then the accused can be released only on bail application. Therefore, the SLP of the accused should be rejected. After hearing the arguments of both the parties, the Supreme Court asked the High Court to complete the hearing in SOG's petition and give its decision.
