The US government has made a big announcement for the foreigners working there. United States Citizenship and Immigration Services (USCIS) H-1B Clarification has been issued for visa holders. It says what options will they have if the company fires them. It says that a non-immigrant worker will have four options to stay in the US if he or she quits the job or the company fires him. However, these options will be available only to those who fulfill certain basic conditions.
There will be four options for employees
First, the employee may file an application for change of nonimmigration status after leaving the job. Secondly, he can file an application for adjustment of status. Third, he or she can file an application for a 'mixed situation' employment authorization document. Fourth, he can take advantage of a non-trivial application to change employers.
Any option must be exercised within the grace period
USCIS said in an official circular, “If any of the above options are exercised within the 60-day grace period, the nonimmigrant stay in the United States may be extended for 60 days, even if the employee The status of the person regardless of his/her prior non-immigration status is terminated.” The circular also said that if the employee does not exercise any option during the grace period, he and his family members (dependents) will have to leave the US within 60 days or at the end of the official validity period.
Millions of foreigners live in America for jobs
This clarification issued by the US government is important for the millions of foreigners who work for American companies and live in America. A large number of Indians work in America. Especially they work in big IT companies like Microsoft, IBM. After this clarification from the government, such people will not have to face any problem.
