Mumbai: Yesterday the Bombay High Court reprimanded BMC in connection with the problem of illegal fairs which is becoming increasingly serious in Mumbai. The High Court said that all over Mumbai and especially in the suburbs including Andheri, Malad, Colaba and Kandivali, wherever you look, all you can see are fairies, no roads or streets in sight.
Noting that stalls blocking roads and footpaths cause nuisance to pedestrians and motorists, the court said that even if a stall is licensed, they are not allowed to stall on the footpath or in the middle of the road or No right to set up a stall. , The High Court had ordered the BMC to submit a systematic list of authorized fairings on footpaths and roads between Chhatrapati Shivaji Terminus and the High Court in Daxim Mumbai by January 25, 2025.
The court emphasized that if a street vendor has been doing business by setting up a cart at a place for years, then that street vendor does not get a permanent right to stand there.
It is the responsibility of the municipality and the police to take action against illegal fairs. The court had earlier also asked the municipality to seek the help of the State Reserve Police Force if the police force was inadequate for the operation to remove the feria. If the police appears helpless in removing the feria, it will never be carried out.
The High Court said that the action should continue in all the 20 areas where the municipality had mentioned during the last hearing where action was being taken against hawkers.
Citizens’ right to walk freely on the road
Citizens have the right to walk on the road without any obstruction. Instead of roads or footpaths in Mumbai, fairies are seen wherever you look. The High Court itself took cognizance of the problems of unauthorized fairs. The bench of Justice Ajay Gadkari and Justice Kamal Khatta said that the vendor who does not have a valid license should be removed. In such a situation, it should also be understood how much trouble the common man and the pedestrian have to face.
Even if it has been going on for years, illegal activity does not give rise to any rights. It was commented that in the name of action against Ferias, people were being hoodwinked.
