Not only CBI, ED will also investigate the illegal mining case in Dhanbad: Jharkhand High Court | News India

Ranchi, October 5 (HS). Jharkhand High Court has ordered the Enforcement Directorate (ED) to register a PE along with the CBI and conduct a preliminary investigation in the case of illegal mining in Dhanbad. During the hearing, the court has said in its decision that after the allegations are found true in the preliminary investigation, the matter should be investigated by registering a regular FIR.

The court has also directed all police officers to cooperate with the CBI in the preliminary investigation. The court has made a scathing comment on the attitude adopted by the state government during the hearing of the writ petition filed by Arup Chatterjee. Commenting on this matter, the court has said that the government was determined that the court should not pass any order. After hearing the petition and reserving the decision, the court has taken seriously the case number 10676 filed by the state government.

The court has said in this matter that after hearing the petition, the decision was reserved on September 24. After this, IPA number 10676 was filed by the government on 26 September. In this, it has been said by the government that the court should decide on IPA number 9800 before giving its verdict. This IA was filed in the court with the intention that the court could not take any decision on the original petition. Therefore the court rejected this IA petition.

The court said in its decision that in the 14th paragraph of IA No. 9800, it has been stated on behalf of the government that till now the police has not been able to conduct even the preliminary investigation into the allegations made in the online FIR filed on May 11. It has also been said by the government that the police do not have the right to investigate this matter. In view of the facts mentioned in the IA filed by the Government, the Court has remarked that it appears that the Government is intent on not registering an FIR against its senior officials.
