The Enforcement Directorate said in the court, ‘Destroying phones on a large scale shows the intention to hide the crime. The ED told the court that, in order to destroy digital evidence on a large scale, the proceeds of crime, money trail as well as evidence of involvement in the process/activities connected with the proceeds of crime were deliberately destroyed. Evidence implicating the crime of money laundering was destroyed.

‘Sisodia changed the phone on the same day LG sent the complaint to CBI’

The Enforcement Directorate said in the court, Manish Sisodia destroyed a phone on the same day when the LG had sent the complaint to the CBI, which he had been using for a long time. ED informed that, during investigation and interrogation, Manish Sisodia has disclosed that he was using a mobile phone for a long period of time (at least from last 8 months), which was changed exactly on 22.07.2022, The ED said that all this was done on the date when the complaint in the liquor scam case was sent to the CBI by the LG.

The ED said, “Using another person’s SIM card and handset reveals a well-planned plan to destroy evidence.” The purpose of using a SIM card and handset registered in the name of another person is to deny that the WhatsApp/data associated with the SIM and the data stored in the phone belong to him. This shows a well-planned plan to destroy evidence and destroy mobiles.”

Calling at Kejriwal’s residence, the documents were handed over to the secretary.

The ED told the court that Sisodia’s secretary revealed that Sisodia called him to Kejriwal’s residence and handed over the GoM document, where the increased margin was mentioned for the first time. ED further stated that, it was disclosed by the then Secretary of Manish Sisodia, Manish Sisodia called him to CM Arvind Kejriwal’s residence between these dates (i.e. between 15th and 19th) and handed him a document, which contained the GOM report. Based on which the document dated 19.03.2021 was typed, which was received from another computer from the office of Manish Sisodia. This document included 12% margin for wholesalers for the first time. The ED said that the change in profit margin happened when the South Group was in Delhi.

South’s group was staying in the business center of Oberoi Hotel

Enforcement Directorate (ED) said that, investigation has also revealed that members/representatives of South Group were staying at Oberoi Hotel, New Delhi from 14 March 2021 to 17 March 2021. The business center of the Oberoi Hotel was used by representatives of the South Group. The changes in the draft GoM report (5% to 12%) happened during this period.
