Mandatory two-year maternity leave is wrong, BSA's order cancelled | News India

Prayagraj, 28 August (HS). Allahabad High Court has cancelled the order of BSA Rampur refusing to grant leave on the basis of the requirement of two years gap for maternity leave.

The court has cancelled the order and directed to grant 180 days of maternity leave to the petitioner. The court has also directed to pay the salary for this period. This order has been passed by Justice Prakash Padia after hearing the petition of Kushal Rana. The petition was filed challenging the order of BSA Rampur dated 9 August 2024, by which the petitioner's maternity leave was rejected on the basis of the mandatory period of two years. The court said that this issue has already been decided by the High Court. Therefore, it is wrong to refuse maternity leave on the basis of the mandatory period of two years.
