High Court stays transfer of excise constable | News India

Prayagraj, 27 August (HS). Allahabad High Court has stayed the transfer of Constable Laxmi Singh posted in the Excise Department. Considering the transfer order as prima facie malicious, the court has issued a notice to the Excise Department and sought a reply. Earlier, on the order of the High Court, Excise Commissioner Allahabad Adarsh ​​Singh appeared in the court and submitted an affidavit.

Justice JJ Munir is hearing the case. The petitioner told the court that action has been taken against him several times in the past. On the basis of which a charge sheet has been issued to him. The court said that looking at the entries in the dispatch register, it appears prima facie that the allegations made by the petitioner are not false. There appears to be a malicious intent behind the action taken against him. The remarks made against the petitioner have nothing to do with the charge sheet.

The court said that the charge sheet is not the subject matter of the petition. The petitioner can challenge it separately. The court has exempted the commissioner from personal appearance on the next hearing. The court has suspended the transfer order of the petitioner and the order cancelling his representation and has ordered the petitioner to continue working on his post and pay him regular salary.

It is known that Lakshmi Singh was transferred from Varanasi to Kaushambi, which was challenged in the High Court. On 08 July 2024, the court directed the petitioner to give a representation to the Excise Commissioner, which was rejected by the department.

The court said that prima facie it appears that the department rejected the representation with arrogance and malice and sent a charge sheet to the petitioner employee by post on July 11, 2024, just three days after our order of July 08, 2024. The court had summoned the Excise Commissioner with the record on August 23 for clarification on this matter.
