Avnish Dixit presented in court amid tight security, petition for recording written statement rejected

Kanpur, 09 August (HS). The accused journalist Avnish Dixit, who is accused of illegal occupation of land worth crores, was presented in the court by the police amidst tight security on Friday. The Chief Judicial Magistrate rejected the petition of Avnish Dixit to record a written statement before the court demand, while Avnish was released after adding the section of organized crime in the case of robbery.

Bail was also sought on behalf of Dixit in that case, for which the court has fixed the date of August 13.

It is noteworthy that on 28th July, a case was registered in Kotwali on the complaint of Lekhpal Vipin Kumar against former president of Kanpur Press Club Avnish Dixit for occupying Nazul land situated in Civil Lines. At the same time, on the complaint of Samuel Gurudev Singh, who was residing on the same land, a report of robbery, extortion, molestation was lodged against Avnish Dixit and about 12 named and 20 to 25 unknown people. In the case of robbery, the investigator had filed an application in the CJM court and demanded remand. Police told in the application that Avnish had said in his statement that he had hidden the looted chain and documents in the school. Despite a lot of search, the chain and documents were not found, for which remand was sought.

Avnish's lawyer Shivakant Dixit had sought time to file an objection on the remand petition, on which the court had fixed the date of 9th August. During the hearing on Friday, lawyer Shivakant Dixit told the court that the police have recorded fake statements, no statement has been recorded from Avnish's side about hiding the chain and documents. He also said that before the remand of the accused, his written statement should be recorded.

The prosecution objected to this. The prosecution said that it is the right of the investigator to investigate the case, there is no such rule that statements should be recorded in the court first. After which the court rejected the petition for a written statement and fixed the date of hearing on remand as 13 August.
