Refusal to cancel FIR registered in murderous attack on student leader

Prayagraj, July 18 (HS). The High Court has refused to quash the FIR lodged in Colonelganj Police Station, Prayagraj against Rahul Singh, accused of murderous attack on Allahabad University student leader and state vice-president of Bharatiya Janata Yuva Morcha Rohit Mishra.

The court said that the allegations prima facie constitute a crime. Therefore, the FIR cannot be cancelled. However, the court has given some relief and said that if the petitioner files an anticipatory or regular bail application in the competent court, then the application should be decided as soon as possible according to the law.

This order has been given by the division bench of Justice Rajiv Gupta and Justice Surendra Singh while disposing of the petition filed by Rahul Singh demanding cancellation of FIR.

The petitioner says that he has been falsely implicated. The allegations in the FIR do not constitute any criminal case against him. FIRs have been filed by both sides and people from both sides have been injured.

The public prosecutor and the complainant's lawyer said that the allegations disclose the crime. Some decisions of the Supreme Court were cited and it was said that the FIR should not be cancelled. On this, the court said that prima facie crime is made out, the FIR cannot be cancelled.
