Bail plea of ​​accused of raping a minor rejected

Prayagraj, May 28 (HS). Allahabad High Court has rejected the bail plea of ​​the accused of raping a minor and considering the interest of justice and the nature of the crime, has directed the trial court to complete the trial in a time bound manner within one year by taking all possible binding legal action.

The court has said that the crime is serious. Releasing the main accused on bail would not be appropriate for a fair trial. The petitioner has been in jail since 22 February 24. This order has been given by Justice Ajay Bhanot while rejecting the bail plea of ​​Ankit Yadav of Rajgarh Mirzapur.

Opposing the petition, the complainant's advocate and additional government advocate told the court that the High Court's instructions have been followed in the Junaid case. A copy of the bail petition has been given to the victim and Child Welfare Committee Mirzapur. The victim is a minor. The petitioner is the main culprit. He is accused of rape. The medical report supports the prosecution's evidence. It is not appropriate to grant bail in a serious crime.

The court has ordered the trial court to take all steps including imposing penalty on the delayers so that the trial can be scheduled in a timely manner. The court has also ordered the witnesses and lawyers to cooperate in the trial. Along with this, the court has been told that apart from the regular procedure, the summons should be sent to the accused by registered post. The court has ordered SP Mirzapur to file an affidavit in the court and give an assurance that the summons or warrant will be served by him and the accused and witnesses will be produced in the court.

Earlier, the court had also directed to follow the circular issued by DGP and Principal Secretary Home regarding serving summons and warrants as per the order of a case. Under which SP has been appointed as the nodal officer.

The court has also asked the trial court to submit its report on the progress of the trial to the district judge every 15 days. The court has also directed to arrest and present the co-accused who did not appear in the court. It has also ordered to investigate and take action against the police officers who misbehaved with the victim in the police station.
