High Court's direction, if the land is not needed then return the acquired land or pay compensation


Prayagraj, May 27 (HS). Allahabad High Court has directed the National Highway Authority to either cancel the land acquisition or pay compensation to the petitioner within four weeks. If it cannot do so, then it should give reasons why the petition should not be accepted by imposing heavy damages. The next date of hearing of the petition has been fixed for July 4.

This order has been given by the division bench of Justice MK Gupta and Justice Kshitij Shailendra while hearing the petition of Satish Chandra Jain of Baghpat. The petitioner says that under Section 3D, the authority acquired his land on 5 February 19 and the land vested in the Central Government but no compensation was given.

When the court asked NHI, it was told that it no longer needs the acquired land of the petitioner. Therefore, the award was not issued. On this, the court wanted to know that when the land was given to the central government due to the acquisition order, then how can it refuse to give compensation. The court said that the proceedings under section 3D should be cancelled and the land should be returned or compensation should be given to the petitioner.
