Mathura, 25 September (HS). The Allahabad High Court heard the Muslim side's recall application in the Mathura-based Sri Krishna Janmabhoomi and Shahi Idgah dispute case on Wednesday. The mosque side demands that the recall application be heard before deciding the issue of dispute. The Muslim side has filed a recall application against the order of hearing all the cases together. Hearing was held on 18 civil cases filed by the Hindu side. The single bench of Justice Mayank Kumar Jain, while hearing the petitions, has fixed the next hearing on 30 September.
When the hearing in this case started on Wednesday, the court was told that permission has been sought to amend some cases on behalf of the plaintiff (Hindu side). At the same time, some lawyers said that they could not get information in advance about the hearing of these cases today. The court of Justice Mayank Kumar Jain is hearing this case. Justice Jain had rejected the applications of the Muslim side challenging the cases of the Hindu side on August 1, 2024 and said that all the cases of the Hindu side are maintainable (hearable). The court had also said in its order that these cases are not barred by the time limit, Waqf Act and Places of Worship Act 1991. The Places of Worship Act prohibits converting any religious structure that existed on August 15, 1947. The Hindu side has filed 18 cases to take possession of the land and restore the temple after removing the structure of Shahi Idgah Mosque. The dispute is related to the Shahi Idgah Mosque in Mathura, built during the time of Mughal emperor Aurangzeb after demolishing a temple at the birthplace of Lord Krishna. However, the Muslim parties (management committee of Shahi Idgah and UP Sunni Central Waqf Board) have opposed these lawsuits on various grounds.
Dinesh Sharma Falahari, Hindu litigant in the Sri Krishna Janmabhoomi Idgah case, said that today the court heard all the cases in which the case was filed to remove Idgah Mosque and Mina Mosque from the birthplace. Today, during the debate, the Hindu party requested the honourable court to hear the case every day. Judge Mayank Jain gave the date of hearing on September 30 and said that such an arrangement cannot be made right now so that the hearing can be done every day. On this occasion, Metropolitan President Naresh Thakur, National Secretary Dr. Jamuna Sharma, Ashu Dixit, Rajesh Pathak, Jai Ram Sharma, Rahul Gautam, Haridas Baba, Ramdev Yadav, Gunjan Sharma, Richa Sharma, Mahendra Singh Baghel, etc. were present.
