Court seeks clarification from Bhadohi SP for filing routine chargesheet in dowry harassment case, also summons investigation officer | News India

Prayagraj, September 17 (HS). Allahabad High Court has directed SP Bhadohi to explain why the police is filing a chargesheet in a routine manner against the husband's relatives in dowry harassment cases without clear allegations, while the Supreme Court has clearly instructed that a chargesheet should not be filed in a routine manner against the husband's relatives in dowry harassment cases.

The court has also directed the investigating officer to appear on the next hearing date of September 30. The court has also issued notice to the complainant and has banned any harassing action against the petitioners. This order has been given by Justice Rajveer Singh on the petition of Ankit Kumar Dubey and 7 others.

The petitioner says that the victim herself has not mentioned the date of the incident in the statement recorded to the police under section 161. Whereas in the FIR it is said that on 5 January 24, she was beaten up and thrown out of the house due to dowry harassment. They got married on 11 May 2022. The victim has implicated the entire family by making general allegations. She has even accused two unmarried brothers-in-law and two married sisters-in-law who live in her house. The police have filed a charge sheet against everyone without any concrete evidence. The court said that it seems that the police did not investigate properly, while the Supreme Court has clearly said that without a clear allegation, the husband's relatives should not be made accused in a routine manner. The next hearing on the petition will be on September 30.
